These General Conditions regulate the purchase of the products offered on the website www.ekohunters.com, owned by EKOHUNTERS S.L. (hereinafter, EKOHUNTERS).

The purchase of any of the products implies the full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Special Conditions that may be applicable to the purchase of certain products.

These General Conditions may be modified without prior notice, therefore, it is advisable to read their contents carefully before proceeding with the purchase of any of the products offered.

1. IDENTIFICATION

EKOHUNTERS, in compliance with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, hereby informs you that:

All notifications and communications between users and EKOHUNTERS shall be considered effective, for all purposes, when they are made by any of the aforementioned means.

3. PRODUCTS

The products offered, together with their main characteristics and price, are displayed on the screen.

Mainly, the products offered are eco-designed furniture, lamps, decoration and lifestyle items.

EKOHUNTERS reserves the right to decide, at any time, the products and/or services offered to Clients. Thus, EKOHUNTERS may, at any time, add new products and/or services to those currently offered. Likewise, EKOHUNTERS reserves the right to withdraw or cease to offer, at any time and without prior notice, any of the products offered.

This is without prejudice to the fact that the acquisition of any of the products may only be made by means of the USER’s subscription or registration, with EKOHUNTERS providing the interested party with a User name and password, which will identify and personally enable him/her to access the products.

Once inside www.ekohunters.com/es, and in order to access the contracting of the different products, the User must follow all the instructions indicated in the purchase process, which will imply the reading and acceptance of all the general and particular conditions set out in www.ekohunters.com.

4. AVAILABILITY AND SUBSTITUTIONS

PRODUCTS

EKOHUNTERS intends to guarantee the availability of all products that are advertised through www.ekohunters.com . However, in the event that any product ordered is not available or if the product is out of stock, the customer will be informed.

Most of the products offered are made to order and are therefore not in stock. In the event that a product marked “in stock” is purchased and when transferring the purchase to the supplier, it is not available, the customer will be notified as soon as possible.

If the product is not available, and the consumer has been informed of this, EKOHUNTERS may supply a product of similar characteristics without an increase in price, in which case, the consumer may accept or reject it by exercising his right of withdrawal and termination of the contract.

In case of unavailability of all or part of the order, and the rejection of replacement products by the customer, the refund previously paid will be made by the same method of payment by which the purchase was made.

5. PURCHASING AND/OR CONTRACTING PROCESS

To make any purchase on www.ekohunters.com , it is necessary for the customer to be of legal age.

Furthermore, it will be necessary for the client to register at www.ekohunters.com by means of a data collection form in which he/she provides EKOHUNTERS with the necessary information for contracting; data which in any case shall be true, accurate and complete regarding his/her identity and which the client must expressly consent to by accepting EKOHUNTERS’ privacy policy.

The steps to follow to make the purchase are:

  1. Register on our website.
  2. Select product(s) and add to cart.
  3. Enter the details according to the payment method and enter the shipping details.
  4. Read and accept the terms and conditions and confirm purchase.

It is also recommended that the customer prints and/or keeps a copy of the terms and conditions of sale on a durable medium when placing his order, as well as the proof of receipt sent by EKOHUNTERS by e-mail.

BILLING

You will receive an invoice with your order.

For this purpose, the customer consents to the invoice being sent to him in electronic form. The customer will receive it by e-mail.

6. DELIVERY

PRODUCTS

The order will be delivered to the address designated by the customer at the time of contracting according to the method chosen.

The scope of delivery covers the following areas: Internationally.

DELIVERY METHODS AND DEADLINES

Orders are sent by post.

The approximate delivery time is 5-7 days for orders in stock. However, the estimated delivery time depends on the geographical area of the customer, as well as the existence of stock or production time of the product(s).

7. PRICES, CHARGES AND TAXES

The prices of the products listed on www.ekohunters.com/es are expressed in Euros, unless otherwise stated, and are guaranteed for the duration of their validity, unless there is a printing error and whatever the destination of the order.

PRODUCTS

The final prices of all products (and, where applicable, the final prices per unit of measurement, when mandatory) together with their characteristics, offers, discounts, etc., are reflected in each of the articles that appear in the catalogue of www.ekohunters.com .

  • The products are inclusive of VAT (as well as any applicable tax).
  • Applicable taxes are indicated and applied to the final price before the customer finalises the purchase in the General Users section. This is not the case for the section for users aimed at companies and public bodies (TRADE).  
  • Shipping costs: The shipping costs applicable to each geographical area are applied to the final price before the customer completes the purchase.
  • Other additional costs: The prices do not include the shipping costs of the products. These are detailed in the payment process (shopping cart) and must be accepted by the Purchasing User before finalising the order.  In the case of an EXPORT/IMPORT (outside the European Union), the final price paid for the product does not include the costs corresponding to Duties and Customs.  These costs will be paid by the customer upon arrival of the product in the country of destination.

The prices of the products may vary at any time. In this case, the price to be applied will be that in force on the date the order is placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before the customer formalises acceptance.

9. PAYMENT METHODS

These payment methods are available to you:

a. By credit or debit card

You can pay immediately through Banco Sabadell’s SSL secure payment gateway. If any refund or cancellation of the order is necessary, the amount will be reimbursed through the same payment card.

b. By bank transfer

By cash deposit or bank transfer payable to:

The customer’s name and order number must be indicated when making the transfer.

c. PayPal

The payment of the order will be authorised through PayPal, but no money will be withdrawn until PayPal verifies that it is correct. To do this, it is essential to have a PayPal account.

10. RETURN AND WITHDRAWAL POLICY

According to the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without having to state the reason and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007, of 16 November, which approves the text referred to in the General Law for the Defence of Consumers and Users, by means of the Withdrawal Form intended for this purpose.

This right of withdrawal does not apply, inter alia, to:

  • Provision of services already performed or started (products on order).
  • Contracts for the supply of products which are made to the specifications of the consumer and user or which are clearly personalised, or which by their nature cannot be returned or are likely to deteriorate or expire quickly.
  • Supply of goods which after delivery have been mixed with other goods.

PRODUCTS

The client shall have a maximum period of 14 calendar days from the day of receipt of the goods or product ordered to inform EKOHUNTERS of his wish to withdraw from the contract. For this purpose, the Withdrawal Form is made available to the customer.

Withdrawal implies that EKOHUNTERS will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for payment (provided that the product purchased does not fall within the exceptions indicated above).

During this period, the consumer shall inform the entrepreneur of his decision to withdraw from the contract by filling in the form at the end of this document and sending it to the e-mail address of EKOHUNTERS.

EKOHUNTERS shall provide the consumer with an acknowledgement of receipt of the withdrawal on a durable medium.

In order to return a product it is essential that it is in perfect condition and in its original packaging, with all its accessories and without having been used.

Once we receive your request, we will contact you with the details of the return.

The customer shall bear the costs of returning the goods.

11. GUARANTEE

Products purchased through www.ekohunters.com/es are covered by a 3-year warranty period from the time of purchase, which covers any manufacturing defects in the product, as well as any faults that may occur during this period.

Consumable products, defects caused by improper use or manipulation, connection to the mains other than that indicated, incorrect installation or defects resulting from any external cause are excluded from the guarantees.

For products of a durable nature, the consumer shall be entitled to adequate technical service and the availability of spare parts for at least 5 years from the date on which the product ceases to be manufactured, without the price of spare parts being increased when they are used for repairs.

To avoid problems with the installation or operation of the purchased product, make sure that you have followed the installation and operating instructions contained in the user manuals.

If the purchased product still does not work properly, you should immediately contact the manufacturer’s customer service and technical support or, if applicable, the representative or distributor.

The technical services will usually require you to provide them with the following data:

  • Invoice number.
  • Identification of the specific model.
  • Serial number.

12. LIABILITY AND DISCLAIMER OF LIABILITY

The consumer and user has the right to have the product repaired, replaced, the price reduced or the contract rescinded, in accordance with the provisions of Chapter II Title IV Book II of the General Law for the Defence of Consumers and Users.

If the product is not in conformity with the contract, the consumer may choose between repair or replacement of the product, both free of charge for the consumer, which shall be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended.

If, once the repair has been completed and the product has been delivered, it is still not in conformity with the contract, the consumer may demand its replacement, a price reduction or the termination of the contract.

  1. CUSTOMER SERVICE AND COMPLAINTS

To lodge any complaint or claim before EKOHUNTERS, the customer must contact the customer service department through the dedicated department.

In the case that the product is not in good condition and the causes attributable to this, are not a consequence of the client, this will be entitled to the return of the product, being vital to carry out these steps for a prompt and positive correction of the incidence, due to the participation of third parties (logistics operators) in the process of buying and selling:

 1 – Check the condition of the packaging and the product before signing the reception document offered by the logistics operator responsible for such delivery. 

1.1- If the customer detects any anomaly, he/she must take photos of the packaging (360 degrees) as well as of the inside of the package and product, where both the protections included in the product and the damage can be seen. The customer must mark the delivery as NOT CONFORMED. 

This milestone is essential for Ekohunters to be able to initiate the claim process against the supplier and logistics operator with guarantees and legally respond to the customer’s claim. If these steps are not carried out correctly, and the claim is rejected for these reasons, Ekohunters will not be obliged to meet the right of refund of the order. 

2- The customer must submit a claim within 48 hours, including all documentation (photos and description) necessary to initiate the investigation / claim by Ekohunters against third parties (supplier and logistics operator) through the Claims Form.

This return due to defect or bad condition of the product will not be considered a right of withdrawal. 

In case of being accepted the claim of the client EKOHUNTERS SL undertakes to reimburse the amounts paid by the customer using the same means of payment used by it, unless otherwise provided. EKOHUNTERS SL will pay the amounts paid by the customer within 14 calendar days from the date of acceptance of the claim. EKOHUNTERS SL and the customer may also agree to return the item for another of equal condition and price.

According to the EU Consumer Online Dispute Resolution and in accordance with Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr/.

  1. APPLICABLE LAW

The present conditions shall be governed by the Spanish legislation in force.

The language used shall be Spanish.
